NEX Terms of Service

Welcome to NEX (the “Application” or “NEX”). These Terms of Service (“Terms”) constitute a legal agreement between you (“User”) and the developer of NEX (“we,” “us,” or “our”).

Please read these Terms carefully before using the Application.

By clicking “Agree,” “Accept,” or by using the Application, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. Service Description

  1. NEX is a VR/XR video player designed to run on devices such as Meta Quest.

  2. The Application does not provide, host, distribute, or sell any video content. All content must be supplied by the user or accessed through user-authorized sources.

  3. NEX supports the following video sources:

    • Local files stored on the user’s headset;

    • Devices on the user’s local network (such as Mac, Windows PC, NAS) via SMB / DLNA protocols;

    • External storage devices such as USB drives;

    • Media accessed through NEX Link, installed on a user’s computer.

  4. The Application only provides playback functionality and does not review, verify, or moderate any content accessed or played by the user.

2. User Obligations

When using the Application, the user agrees to comply with the following requirements:

  1. Legal Use of Content

Users must ensure that the video content they access or play has a lawful source and does not infringe upon copyrights, privacy rights, or any third-party interests.

  1. Compliance with Laws and Regulations

    Users may not use the Application to engage in any activity that violates applicable laws or regulations, including but not limited to:

    • Sharing or playing infringing content;
    • Disseminating violent, obscene, illegal, or harmful material;
    • Unauthorized access to networks or devices;
    • Conducting malicious, harmful, or disruptive activities.

  2. Device and Network Security

Users are solely responsible for the security of their devices, network environments, and sharing configurations. We are not liable for risks arising from insecure user environments.

  1. Prohibited Misuse

Users shall not reverse-engineer, decompile, modify, tamper with, or exploit the Application in any unlawful or improper manner.

3. Permissions and Access

To deliver its intended functionality, the Application may request certain device permissions (subject to platform limitations), including but not limited to:

  1. Local storage access – to read video files stored on the device;

  2. Network access – to connect to SMB/DLNA devices or to a computer via NEX Link;

  3. External storage access – to read files from USB drives or other external media. Granted permissions are used strictly for accessing user-provided video content. We do not upload or collect the contents of users’ files.

4. Privacy Protection

We respect user privacy and do not collect personally identifiable information, nor do we access, upload, or analyze the video content users play.

5. Intellectual Property Rights

  1. All intellectual property rights related to the Application—including source code, design, interface, artwork, branding, and trademarks—belong to us.

  2. Users may not copy, modify, distribute, or commercially exploit any part of the Application without prior written permission.

6. Service Changes, Suspension, and Termination

  1. We may update, modify, or improve the Application and its features at any time.

  2. We reserve the right to suspend or terminate the service for any user under the following circumstances:

    • The user violates these Terms;

    • The user engages in unlawful behavior;

    • Service becomes unavailable due to force majeure or technical issues.

7. Disclaimer of Warranties

  1. The Application functions solely as a playback tool and is not responsible for the legality of any content accessed by users.

  2. Users assume all risks associated with accessing third-party devices or networks through the Application.

  3. We are not responsible for playback issues caused by device failures, user network conditions, or third-party services.

  4. The Application is provided “as is” without warranties of any kind, express or implied.

8. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the jurisdiction where the Application’s developer is located.

Any disputes arising from these Terms shall first be resolved through friendly negotiation. If negotiation fails, either party may submit the dispute to a court with proper jurisdiction.

9. Updates to These Terms

We may revise these Terms periodically due to business adjustments or legal requirements. Updated versions will be posted within the Application and become effective upon release.

Continued use of the Application indicates acceptance of the updated Terms.
